In a major ruling on March 5, 2026, the Federal High Court in Abuja has cleared suspended Deputy Commissioner of Police (DCP) Abba Kyari and his two brothers of all charges in a 23-count asset declaration case brought by the National Drug Law Enforcement Agency (NDLEA).
Justice James Omotosho, presiding over the case, said the prosecution failed to provide sufficient evidence linking the defendants to the disputed properties, which included estates in Fountain Estate, Kasa, Linda Chuko Road in Asokoro, and Maiduguri, Borno State. The charges also included allegations of conspiracy and swearing false affidavits.
Describing the NDLEA’s case as “watery,” Justice Omotosho noted that no title documents, proof of possession, or other evidence established ownership of the properties. Kyari had maintained that the Borno State properties belonged to his late father and were inherited by him and his siblings.
The judge also criticized the inclusion of Kyari’s brothers in the conspiracy charge, stating the prosecution could not substantiate their involvement. He added that the defendants had served the country and should not face persecution.
This acquittal applies specifically to the asset declaration and related financial charges brought by the NDLEA. Separate cases, including the long-running drug trafficking case previously linked to Kyari, remain independent and may continue.
